The Supreme Court has temporarily blocked the decision by the Constitutional court that required judicial officers who had been appointed to executive and constitutional offices to resign.
This follows an application by the Attorney General of Government seeking an interim stay of the implementation of the Constitutional court Judgement which declared the appointment of a substantive judicial officer to an executive office before resignation; as unconstitutional.
A Penal of five Justices of the Supreme Court led by the Chief Justice Alfonse Owiny Ddollo ruled that the matters AG has presented before Court are substantially important points of law for Court’s consideration; meaning that the affected Judicial Officers like the DPP, JSC and EC Chairpersons can now return to office until the main application in which AG wants an injunction permanently restraining the said decision; is disposed of.
